Parking queries

We have a considerable volume of queries regarding parking within estates such as New Farm Park and Nether Robertland, mainly about what types of vehicles can or cannot park within the area.

Choice Places has a parking policy which outlines the restrictions and who to contact should a resident be concerned about abandoned vehicles.

Cars

  • Where car parking is provided, this is available to our residents on a first come first serviced basis
  • No spaces within our management have been allocated unless the tenancy/occupancy agreement or property deeds of conditions state otherwise.
  • The exception to this is where a disabled car parking space has been created for use by a person holding the appropriate Blue Badge parking permit. (Please note these are disabled parking bays which have been created on East Ayrshire Council owned areas.)

Lorries, caravans, trailers or boats

  • The parking of a lorry, caravan, trailer or boat is not permitted within residential designated areas without first obtaining Choice Place’s written consent.

Such vehicles will not be permitted to be parked on:

  • areas designated solely for the parking of motor vehicles; or
  • within the boundaries of the property, which includes garden ground, driveways, etc.; or
  • on any open spaces, grassed areas, footpaths or pavements.

Obstructions & offences

  • Vehicles using communal parking areas must be road legal.
  • The Motor Vehicle Regulations Act 1986 provides authorities power to deal with obstructions caused by parking on pavements, grass verges and in front of private driveways.
  • The Road Traffic Act 1988 covers a range of offences, including leaving vehicles in a dangerous position and driving vehicles elsewhere than on the road. Residents reporting illegal parking on land out with that owned by Atrium should be directed to contact the Police.

Disputes

  • At all times, residents and their visitors are expected to park with consideration to others and ensure their vehicle does not cause a nuisance or annoyance.
  • Choice Places will not normally intervene in parking disputes between residents unless someone is in breach of their tenancy due to the way they are using parking facilities, the way they are behaving towards other residents (i.e. where their actions are serious enough as to cause alarm and distress to others) or they are abusing facilities due to multiple vehicle ownership.

Monitoring

Regular estate inspections will monitor compliance with these requirements and appropriate action will be taken where vehicles are parked improperly and/or on land in Choice Places ownership.

Abandoned Vehicles

If you believe a vehicle has been abandoned, you should first check the DVLA website www.gov.uk/check-vehicle-tax which will ask you to provide the registration number. This will advise is the car has a valid road tax and mot.

If it doesn’t then you can report the vehicle abandoned to East Ayrshire Council via their Our East Ayrshire Portal https://our.east-ayrshire.gov.uk/, which allows you to contact them regarding various different issues.
